RM 10 Million Accident Claim

I wonder how they came about to the RM 10 million figure.

2 years old, if the victim is to live up to an average age of 78 years old, she will be given about:

RM 10,000,000 / 76 years= Approximately RM 131,578.95 a year

I have heard of friends who were involved in similar accidents and they told me that the law firms involved in such cases usually receive a substantial fee from the compensation given out to the victim.

However, most of the time, such cases, especially those where the victim are dead, are usually dealt outside the court, since it can take “many” years for the case to be settled.

Well, it took 8 years to actually win this case, just goes to show how effective our judiciary system is.

Highest accident claim in the country…

Sophia Isabel, from Kuala Lumpur, was only two years and three months old when the car driven by her mother was involved in head-on collision with a lorry at the 67th kilometer of Jalan Kuantan-Maran, on Jan 3, 1999.

Judge Sarimah Hashim read the decision, awarding a total of RM9,821,909.88, including special damages, pre-trial and post-trial costs, and injuries suffered by Sophia.

    what was not clear in The Star’s report was who was asked to pay. At first I thought the doctor/hospital was the one being sued, then it turned out that the tow truck company (Kuantan Crane) was responsible. Then I thought since The Star’s report said the accident involved a collision with a lorry, I thought the manner in which the tow truck pulled the car out of the wreckage while Sophia was still in the Kancil was the reason for the whole thing.

    Then in Malaysian Bar website, things were made clear at last: the Kancil was hit by a tow truck belonging to Kuantan Crane.

    The Star should improve on their writing.
